Non-Disclosure Agreement

“Participant” acknowledges that he/she may receive, view, witness, discuss or otherwise be exposed to proprietary and confidential information of and belonging to the Center for Operator Performance (“COP”) and/or COP members and contractors and agents of COP while participating in a COP biannual meeting, including without limitation products, formulae, formulations, advertising, designs, equipment, processes, operations, techniques, strategies, methods of distribution, capabilities, systems and computer programs, technology, specifications, customers, marketing and sales information, business plans, financial data, consumer data, employees, or any other private matters (“Confidential Information”). The Confidential Information was developed or obtained by its owner by investment of significant time, effort and expense.

In consideration of Participant being permitted to participate in a COP biannual meeting, Participant agrees not to use or disclose Confidential Information except as is necessary to perform his/her obligations in connection with participating in a COP biannual meeting and in accordance with any other agreement Participant enters into with the owner of the Confidential Information. Participant will take reasonable security precautions, at least as great as the precautions taken to protect Participant’s own confidential information of a similar nature, to prevent the disclosure of the Confidential Information to any third party. The obligations contained in this Agreement are necessary and reasonable to protect the owner of the Confidential Information. Nothing contained herein shall be construed as a grant to Participant of any rights, by license or otherwise, to any Confidential Information. Any violation, or threatened violation of these confidentiality and nondisclosure obligations by Participant will cause irreparable harm to the owner of the Confidential Information, and such owner will be entitled to obtain injunctive or equitable relief, in addition to any other remedies available, as may be deemed proper by a court of competent jurisdiction without posting any bond.

Meeting Topics

Training Tuesday: Calling all trainers!! The meeting will kick off at 8:00AM CT and will emphasize TRAINING with project updates and discussions on new training methods, crew resource management, digital twin fact finding, and an anecdote circle activity.

Working Wednesday: Guest speaker, Stephen J. Guastello, Ph.D, of Marquette University will kick off Wednesday at 8:00AM CT to discuss safety culture and an alternative to the Swiss cheese model.  Project updates will follow, and the afternoon will be spent working – brainstorming the future operator role and new COP projects.
